1. Introduction

These Terms & Conditions (“Terms”, “Agreement”) govern your access to and use of the website www.wayshopee.com.au (“Site”) operated by WayShopee Retail Management Pty Ltd (“WayShopee”, “we”, “us”, “our”). By using the Site you agree to these Terms and our Privacy Policy. If you do not agree, you must not use the Site.

Australian compliance: These Terms operate subject to the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)) and the Privacy Act 1988 (Cth) including the Australian Privacy Principles. Nothing in these Terms limits your non-excludable rights.

2. Use of the Site

• Use the Site only for lawful purposes and in accordance with applicable laws.
• Do not attempt unauthorised access, disrupt security, or interfere with servers/networks.
• Do not copy, reproduce, sell, or exploit Site content without our prior written consent.
• Do not upload malicious code or content that is defamatory, obscene, or infringing.

We may suspend or restrict access where we reasonably believe there is misuse or a security risk.

3. Eligibility & Accounts

To purchase you must be capable of entering a binding contract and provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your credentials and for all activities under your account. Notify us immediately of any unauthorised use. We may suspend or terminate accounts that breach these Terms.

4. Products, Descriptions & Pricing

We sell home and kitchen products including, without limitation, drinkware, cookware, appliances, gadgets, and storage. We take reasonable care with descriptions, images, and prices; however, errors may occur and colours can vary by device.

All prices are in AUD and include GST where applicable, unless stated otherwise. We may correct errors and update information at any time.

5. Orders, Acceptance & Payments

All orders are offers to purchase subject to availability and our acceptance. We accept your order when we dispatch the goods and send a shipping confirmation. We may cancel an order and refund any payment if stock is unavailable, an error occurs, fraud is suspected, or the order breaches these Terms.

Payment must be made using accepted methods at checkout (e.g., card, PayPal, BNPL if offered). You warrant you are authorised to use the selected payment method.

Title & risk: Title passes on full payment; risk passes on delivery to your nominated address.

6. Shipping & Delivery

Shipping services, timeframes, fees, and delivery areas are set out in our Shipping Policy. Delivery times are estimates only and may vary due to factors outside our control. We currently deliver Australia-wide only.

7. Returns & Refunds

See our Returns Policy and Refund Policy for how to initiate returns and how refunds are processed. Your rights under the ACL apply in addition to our policies. For a major failure you are entitled to a refund or replacement; for a minor failure we may repair, replace, or refund as permitted by law.

8. Promotions, Gift Cards & Store Credit

Promotions are subject to stated terms and may be withdrawn at any time. Gift cards and store credits are not redeemable for cash (except as required by law) and expire per the terms provided at purchase.

9. Intellectual Property

The Site and its content are owned by or licensed to WayShopee and protected by Australian and international intellectual property laws. You must not copy, adapt, publish, distribute, or create derivative works without our prior written consent. Fair and lawful linking is permitted.

10. User Content (Reviews & Submissions)

• You grant WayShopee a non-exclusive, worldwide, royalty-free licence to use, reproduce, display, edit, and publish your reviews or submissions for marketing and operational purposes.
• You warrant you own or are authorised to post the content and it does not infringe third-party rights or breach any law.
• We may moderate, edit, or remove User Content at our discretion.

11. Third-Party Services & Links

The Site may link to third-party sites or integrate third-party services (e.g., payments, analytics). We are not responsible for their content or privacy practices. Your use of third-party services is governed by their terms and policies.

12. Privacy

We handle personal information in accordance with our Privacy Policy and the Privacy Act 1988 (Cth), including the Australian Privacy Principles. By using the Site, you consent to our collection and use of personal information as described.

13. Warranties & Disclaimers

14. Liability & Remedies

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy that cannot be excluded under the ACL. To the extent permitted by law, our liability is limited, at our option, to repair or replacement of goods, resupply of services, or payment of the cost of doing so. Subject to the foregoing, we are not liable for indirect or consequential loss.

15. Governing Law & Jurisdiction

These Terms are governed by the laws of South Australia and the Commonwealth of Australia. You submit to the non-exclusive jurisdiction of the courts of South Australia and courts entitled to hear appeals from them.

16. Complaints & Dispute Resolution

Please contact info@wayshopee.com.au first so we can try to resolve any issue. This does not limit your right to seek assistance from a consumer protection body (e.g., Consumer and Business Services SA) or to commence proceedings.

17. Suspension & Termination

We may suspend or terminate access to the Site if you breach these Terms or where required for security, maintenance, or legal reasons. Clauses intended to survive termination (including IP, liability, and governing law) continue in force.

18. Changes to these Terms

We may update these Terms from time to time. The effective date above reflects the latest version. Your continued use of the Site after updates constitutes acceptance of the revised Terms.
